07.09.2022 Heard Ms. P. Das, learned counsel appearing on behalf of Mr. S.C. Keyal, Page No.# 2/2

learned Standing Counsel, Customs Department/appellant.

The record shows that no steps have been taken by the appellant Customs Department for service of notice on the respondents since the appeal was filed on 27.07.2010.

Ms. P. Das, learned counsel, submits that the matter was repeatedly informed to the Customs Department/appellant, but there is no response. However, Ms. Das seeks some more time to take up the matter with the Customs Department in regard to the above.

As the instant matter has been pending since the year 2010 against the judgment and order, dated 14.12.2009, passed by the learned Addl. Sessions Judge, Kamrup, Guwahati in Sessions(Special) Case No. 45(K)/2008, acquitting the accused a last opportunity is given to the appellant to take steps for service of notice on the respondents.

Accordingly, the appellant is directed to take steps for service of notice on the respondents as directed earlier within 7(seven) days, failing which, necessary order will be passed in accordance with law.

List after the ensuing Puja Vacation.
