In this petition under Section 397/401 read with Section 482 of the Code of Criminal Procedure, 1973, petitioner Gafur Ali Ahmed challenges the legality, Page No.# 2/2

propriety and correctness of the judgment and order dated 01.06.2022, passed by the learned Principal Judge, Family Court, Barpeta in F.C. (Crl.) No.140/2021, whereby the learned Court below directed the petitioner to pay monthly maintenance to the respondent @ Rs.5,000/- and to her minor daughter @Rs.3,000/- from the date of filing the petition, for maintenance.

Heard Mr. H.A. Ahmed, learned counsel for the petitioner.

Admit.

Issue notice returnable in 4 (four) weeks.

Steps be taken by registered post with A/D as well as by usual process within a week from today.

Call for the LCR from the concerned Court below.

In view of the submission where it is clearly stated that the daughter is presently living with the petitioner and the evidence of PW.1, the impugned judgment and order of the learned trial Court, directing the petitioner to pay maintenance to the daughter @ Rs.3,000/- per month, stands stayed till disposal of this petition. However, the petitioner shall continue to pay the amount to the respondent, as directed by the learned Court below.

List the matter after four weeks.
