Call for the records of the trial Court as well as the appellate Court.

Also heard on I.A.No.1 for suspension of sentence and grant of bail to the applicant.

The applicant stands convicted by the the judgment dated 22.08.2024 passed by the JMFC, Mungeli, District Mungeli, in Criminal Case No.1594/2018 whereby he has been convicted for the offence u/s 224 of IPC and sentenced to undergo 6 months simple imprisonment with further default stipulation, which has been affirmed by the Sessions Judge, Mungeli by judgment dated 13.05.2025 in Cr.A.No.32/2024.

Learned counsel for the applicant would submit that the applicant is in jail since 13.05.2025 and the maximum sentence imposed on him is Simple Imprisonment for 6 months and during the pendency of trial he was released on bail and did not misuse the liberty granted to him. He further submits that hearing of this appeal on merits is likely to take time, therefore, the applicant

may be released on bail.

Per contra, learned State Counsel opposes the prayer. Looking to the short term sentence of the applicant and the fact that the applicant is in jail since 13.05.2025 and further considering the fact that there is no immediate possibility of hearing this appeal on merits, I feel it appropriate to suspend remaining jail sentence and release him on bail.

Accordingly, I.A.No. 1 is allowed and it is directed that the execution of further substantive jail sentence of the applicant shall remain suspended and he shall be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for his appearance before the Registry of this Court on 28.08.2025. He shall thereafter appear before the trial Court on a date to be given by the Registry of this Court and shall continue to appear there on all such subsequent dates as are given to him by the said Court till the disposal of this appeal.
