Heard on I.A. No. 01/2025, application under Section 430 of B.N.S.S., 2023 for suspension of

sentence and grant of bail.

By the impugned judgment dated 09.04.2025 passed by learned 01st Additional Sessions Judge, Bastar, Place at Jagdalpur (C.G.) in Sessions Case No. 58/2022, the appellants have been convicted and sentenced as mentioned below :

Conviction Sentence Under Section R.I. for 05 years and fine of Rs.500/- 307/34 of IPC in default of payment of fine amount, further R.I. for 03 months.

Learned counsel for the appellants submits that the appellants are innocent and are falsely implicated in the case. He further submits that the appellants were already in bail during trial and now in jail after passing of the judgment and appeal is likely to take considerable time. Hence, it is prayed that I.A. No. 01/2025 may be allowed and the appellants may be released on bail.

On the other hand, learned State counsel opposes the application for suspension of sentence and grant of bail. He further submits that the appellants with a common intention to cause death of the injured caused grievous injury to the victim with a sharp-edged weapon i.e., 'Tangiya'. Thus, considering the serious offence committed by the appellants, they

are not entitled to enlarge on bail.

I have heard learned counsel appearing for the parties and perused the material available on record.

Considering the totality of the facts and also taking into account serious nature of allegation, I do not find it appropriate to release the appellants on bail during the pendency of this appeal.

Accordingly, the I.A. No. 01/2025 is rejected.

List this case for final hearing in the next week.
