1. This petition has been filed under Section 397 R/w Section 401 of the Cr.P.C. challenging the impugned judgment dated 23.10.2019 passed by learned 10th Additional Sessions Judge Durg, District Durg (C.G.) in Criminal Appeal No. 0000186/2019, the learned Judge has affirmed the judgment

dated 19.06.2029 passed by the learned Judicial Magistrate First Class, Durg, District Durg in Complaint Case No.1948/2015 for offence under Section 138 of NI Act and dismissed the appeal and sentenced the appellant to undergo SI for 1 year and to pay fine of Rs.1,000/- in default thereof, he shall liable to undergo 1 month SI. Hence, this appeal.

2. Learned counsel appearing for the Applicant submits that in this case, till now no suspension order has been passed in favour of the applicant by this Court. He further submits that he has no instructions from the applicant and he is not in contact with him.

3. In view of above submission, the instant case is dismissed for want of prosecution.

4. The copy of this order be supplied to the Trial Court concerned for information and necessary compliance.
