Mr. R.K. Kesharwani, counsel for the petitioner.

Mr. Anshuman Shrivastava, Panel Lawyer for the State. Mr. Pankaj Agrawal, counsel for the Corporation. Learned counsel for the petitioner would submit that the petitioner has retired on 31.01.2008. As per the Government Circular he is entitled to receive 6 th Pay- scale since 01.01.2006 but till date his case has not been considered. Learned counsel for the Corporation would submit that this case is squarely covered with the judgment of the Hon'ble Division Bench of this Court in case of WA No. 171 of 2017 order dated 12.05.2022.

In the present case, return has not been filed. Let the corporation file counter affidavit to demonstrate what is the financial position of the corporation, whether the financial liability of the corporation has been calculated? Why the pay fixation of its employee as per the sixth pay revision has not been done till today?
