On due consideration, this appeal is admitted for final
hearing on the following Substantial Question of law:
A. Whether, the Judgment and Decree of First Appellate
Court as well as the Trial Court suffers from legal perversity
and is liable to be set aside?
B. Whether, the suit property was required to be
partitioned in the light of the pleading of the parties, material
adduced and provisions underlying the Hindu Succession
Act; if yes (up to What extent & proportion of shares-
Specifically 1/6 th share as claimed by Plaintiffs or 1/9 th
Shares as claimed by the Defendants), after
appropriating/adjusting the portion of land alienated by the
parties?
Issue notice to the respondent No. 1 to 5.
PF as per rules.
Meanwhile, it is directed that status quo of the suit property
shall be maintained by both the parties and the respondents are
restrained to alienate the suit property and shall not create any
Third Party Interest over the suit property, till the next date of
hearing.
List this case after four weeks.
