1. Heard.

2. The present MCC has been filed for restoration of F.A.

No.120/2016.

3. Learned counsel for the Applicant submits that F.A. No.120/2016

was dismissed because of the peremptory order passed by this

Court on 07.07.2021, however, by inadvertence paper-book though

was prepared and was filed in another case. Consequently, the

default has happened, therefore, he may be given a week's time to

place on record the paper-book in this case as all the documents are

within the hold of the applicant.

4. Having considered the submission, let the paper-book be filed

within a further period of two weeks.

5. In view of the above, the order dated 07.07.2021 passed in F.A.

No.120/2016 is recalled. Consequently, F.A. No.120/2016 is

directed to be restored to its original number.

6. It is made clear that if the paper-book is not filed within two

weeks, this order shall lose its efficacy and automatically the order

dated 07.07.2021 shall stand restored.

7. With the aforesaid observation, the MCC stands disposed of.
