1. This review petition has been filed for review of the judgment dated
26.07.2022 passed by this Court in FAM No.12 of 2017 whereby this
Court had granted maintenance of Rs.8,000/- to the respondent/wife
which would be deducted from the source of income of the husband.
2. Learned counsel for the petitioner/husband would submit that
respondent/wife in her affidavit has stated that she is getting salary of
Rs.6100/- and also getting rent of Rs.3500/- per month thereby
Rs.9600/- is her total income per month, whereas, the information
received under the RTI would show that the respondent/wife was
awarded a work from the Nagar Palika Parishad, Tilda-Neora, Raipur
where she is the proprietor of firm to whom certain contract was
awarded and she is continuing to work there therefore, she has
concealed her income and the facts mentioned in the affidavit are
wrong. Consequently, Rs.8,000/- has been granted to the respondent/
wife towards her maintenance and therefore, there has been serious concealment.
3. Heard learned counsel for the petitioner and perused the documents
annexed with the petition. The Annexure-A/4 on which the applicant
has placed reliance is of year 2017. The affidavit of the wife, which was
filed, was in respect of the present state of income. Even otherwise,
perusal of the judgment would show that after considering the salary of
the husband, which is Rs.33,898/- as also from sale of the paddy
income of the husband was shown as Rs.3,25,900/-, the maintenance
amount was granted to the respondent/wife considering the over all
income of the husband. Therefore, there is no apparent mistake on the
face of the record which needs to be corrected by this Court. The Court
was conscious of the fact that wife was having two children along with
her and after considering all the relevant facts, the order of
maintenance was passed. Consequently, we do not find any merit in
the review petition to interfere in the judgment dated 26.07.2022.
4. In the result, this review petition is dismissed.
