Heard on admission.
Perused the impugned judgment of trial Court as well as statement of witnesses.
On due consideration, particularly considering the evidence of the prosecution witnesses that is PW-2, Kiran Verma, it appears that a quarrel took place between the deceased and the appellant for two times on 17.12.2020 and 18.12.2020.
There is no any other clinching evidence with regard to the instigation on the part of the appellant, therefore, in my considered view, it is not a case where leave should be granted.
Accordingly, the instant CRMP is dismissed at admission stage itself.
