Shri Avinash Singh, P.L. for the State. Heard on petition as well as on I.A. No.1 of 2022, an application for grant of interim relief.

Learned counsel for the petitioner submits that the petitioner is giving his services as Staff Nurse since 1989. On the ground that the petitioner was erroneously granted some advance increments, a recovery order has been passed against her, which is dated 19.5.2022 (Annexure-P/1) and dated 25.4.2022 (Annexure-P/2). It is further submitted that the case of the petitioner is clearly covered by the judgment of Supreme Court in the case of State of Punjab vs. Rafiq Masih, reported in (2015) 4 SCC 334, hence, such a recovery cannot be made from her. Hence, it is prayed that appropriate

orders may be passed.

Learned State counsel opposes the submissions made by counsel for the petitioner and prays for time to file reply.

Time is granted accordingly.

List this case after four weeks.

In the meanwhile, it is ordered that the operation of the impugned orders (Annexure-P/1 & P/2) shall remain stayed until the next date of hearing.
