One Criminal Appeal has been preferred jointly by Mohd. Shamim Ansari

and Mohd. Saddam Hussain being aggrieved by the judgment dated 29.10.2020,

by which, they have been convicted for the offence punishable under Sections

364/34 IPC, 302/34 IPC and 201/34 IPC, which was registered as

CRA/1001/2020. Thereafter, one of the Appellants in this appeal, namely, Mohd.

Saddam Hussain has filed separate appeal being Criminal Appeal No. 251/2021.

Since Mohd. Saddam Hussain has already preferred an appeal being Criminal

Appeal No.1001/2020 along with Mohd. Shamim Ansari, therefore, subsequently

preferred appeal being Criminal Appeal No.251/2021 is unnecessary and

accordingly disposed of granting liberty to Shri Ashutosh Shukla, learned counsel

for the Appellant in CRA/251/2021 along with the counsel already appearing for

the co-accused in CRA/1001/2020 subject to filing of memo of appearance on

behalf of Mohd. Saddam Hussain.

With the aforesaid observation, Criminal Appeal No.251/2021 being

unnecessary is disposed of.

List the matter (CRA/1001/2020) for consideration on I.A. No.01 in the next

week.
