Learned counsel for the appellant would submit that judgment and decree was passed by the learned appellate Court on 13.03.2012 and the appeal was filed on 22.02.2013, as such there is delay of 132 days in filing the appeal. He would explain the delay as counsel has not informed regarding the result of appeal in time, which has caused delay in filing the appeal, therefore, the delay may be condoned.
On the other hand learned counsel for the respondents would submit that no explanation has been given for delay, therefore, the application for condonation of delay may be rejected.
Considering the submission made by the learned counsel for the parties, I am inclined to condone the delay of 132 days in filing the appeal. Accordingly, I.A. No. 1 of 2013 is allowed. The delay is condoned. List the case for admission in the 3rd week of June, 2022.
