The Court:- A property vested with the Administrator General,
West Bengal was put up for sale through public auction under the direction
of this Court. The sale was confirmed in favour of the successful bidder,
namely, Esskay & Sons Realtors Private Limited (in short 'Esskay') by an
order dated 28th August, 2024. Esskay had given an earnest money of
Rs.1.85 crores which on the sale being confirmed was converted into part
consideration money. The balance sum of Rs.5.50 crores was paid by Esskay
on 9th January, 2025. The Administrator General, West Bengal had taken
steps to have the conveyance registered but in view of certain clarification
the registering authority at Jharkhand did not register the same. This Court
by orders dated 7th July, 2025, 19th August, 2025, 3rd November, 2025, 19th
January, 2026 and 24th February, 2026 had requested the registering
authority at Jharkhand including the Inspector General of Registration,
Jharkhand to see that the document is registered after complying with the
legal requirements as prevailing for registering a document in Ranchi,
Jharkhand as this Court is not aware of all the formalities required to be
complied with at Jharkhand. It appears that the orders of this Court have
been taken by the registering authority at Jharkhand including the Inspector
General of Registration, Jharkhand in a light and casual manner and as
such, nothing has happened for about a year despite best endeavour from
the side of the Administrator General, West Bengal and all cooperation from
the successful bidder. Neither the registering authority nor the Inspector
General of Registration, Jharkhand have informed the Administrator General
or the successful bidder as to the formalities that are required to be complied
with.
In the aforesaid facts and circumstances, the Inspector General of
Registration, Jharkhand is directed to show cause as to why mandatory
directions will not be passed against the registering authority at Jharkhand
for registering the property. Let such show cause be filed by 30 th April, 2026
in a sealed cover before the Registrar, Original Side of this Court so that the
same can be placed before this Court on the next date of hearing. The
Inspector General of Registration, Jharkhand may also engage an Advocate
to represent him before this Court on the next date.
Let this matter appear in the list on 7 th May, 2026.
Let a copy of this order be transmitted by the registry of this Court
to the office of the Inspector General of Registration, Jharkhand.
The parties shall also communicate this order to the Inspector
General of Registration, Jharkhand.
