This appeal is directed against the order of conviction
and sentence dated 02.08.2023 imposed on the
appellant by the learned Judge Special Court, (POCSO
Act), Berhampore, Murshidabad, a sentence to suffer
simple imprisonment for one month and to pay fine of
Rs.10,000/-, in default, further imprisonment for
seven days.
2. Heard learned counsel appearing on behalf appellant
and perused the judgment.
3. The appeal is admitted.
4. Issue usual notice.
5. Trial Court Record be called for.
6. After arrival of the Lower Court Record, if it is found,
otherwise in order, the formal paper book shall be
prepared within six weeks thereafter.
7. Liberty is given to file application for suspension of
sentence.
8. Realization of fine amount be stayed in the meantime.
9. From the record, it appears that the appellant was
released on bail invoking Section 389 of the Criminal
Procedure Code.
10. The bail is being confirmed with a direction upon the
appellant to furnish bond of Rs.10,000/- with two
sureties of Rs.5000/- each, to the satisfaction of the
learned Chief Judicial Magistrate, Berhampore,
Murshidabad.
