THE COURT: Learned Counsel for the judgment-debtor has submitted that there is no decree at all since the relevant decree has been recalled by the Court, which passed the decree. Learned Counsel has further submitted that there is no scope for proceeding with the decree.

Learned Counsel appearing for the decree-holder has submitted that his client has preferred an appeal against the order which recalled the decree. He wants to file an appropriate application by Friday i.e. 1st December, 2023.

Decree-holder is at liberty to file the said application in accordance with law.

Photocopy of the order dated 8th September, 2023 be kept with the records.

List the matter on 1st December, 2023.
