The subject matter of challenge in this case is

against the judgment dated 21 st December, 2021 passed

by learned Additional District Judge, Khatra, Bankura

in Misc Appeal No. 11 of 2017 permitting appellant to

pre-empt the suit property doing little modification of

the order dted 29th August, 2017 passed by the Trial

Court.

As per submission disclosed by both the parties,

the issues involved in this case are relatable to some of

the issues pending before the Larger Bench, already

constituted for the purpose.

Let there be an order directing that no third party

interest be created in the meantime, pertaining to the

subject property under reference, and the execution, if

any, levied in the meantime, may not be pursued till the

end of January 2023.

List the matter in the 3rd week of January 2023.
