This is an application for expeditious disposal of NDPS Case

No.271 of 2020 pending before the learned Judge, Special Court

under the NDPS Act-cum-Additional Sessions Judge, 5 th Court,

Berhampore, Murshidabad.

It is submitted by the learned Advocate for the petitioner that

petitioner was arrested on 13th December, 2020 in connection with

Samsherganj Police Station Case No.272 of 2020. Police submitted

charge-sheet on 31st May, 2021 against the petitioner. Till date

charge has not been framed. Therefore, the Trial Court may be

directed for expeditious disposal of the case.

The petitioner did not aver in the instant revision as to whether

supplementary charge sheet along with chemical examination report

of the seized contraband articles has been filed by the Investigating

Officer or not. The learned Advocate for the petitioner is also not able

to appraise this Court in this regard.

Since charge has not been framed, question of expeditious

disposal of the case does not arise at all.

However, the instant revision is disposed of directing the Court

below to take proactive step to obtain chemical examination report

and supplementary charge-sheet from the Investigating Officer within

one month from the date of communication of the order. Thereafter,

the Trial Court shall proceed with the case in accordance with law.

The instant revision is, thus, disposed of.

The petitioner is at liberty to communicate this order obtaining

server copy of the same.
