The petitioner seeks conversion from management
quota to NRI quota for admission in MBBS Course,
2022.
Mr. Bhattacharya places reliance upon a circular
issued by the Central Government appearing at pages
57-58 of the writ petition in support of the case.
Mr. Indranil Roy, learned advocate appearing for
National Medical Commission has drawn attention of
this Court to a judgment delivered in WPA 25722 of
2022 (Smita Som Vs. The State of West Bengal & Ors.)
by a Co-ordinate Bench of this Court, wherein such
conversion has not been allowed in State counseling.
It has also been intimated that an appeal is
pending against the said judgement. The fact remains
that the said judgement of the Co-ordinate Bench of this
Court has not been interfered with by the Appeal Court
as on date.
In that view of the matter, hearing of this case is
adjourned for two weeks. The parties will intimate this
Court as to the outcome of the appeal on the next date
of hearing.
List this matter after two weeks under the same
heading.
