The grievance of the petitioner is that the
respondent-authorities insisted upon the vehicle of the
petitioner being of BS-IV model or higher, for the grant
of permanent permit to ply. It is submitted that
temporary permits have been granted successively
from the year 2010 and there is no Regulation in force
to compel the petitioner to run a BS-IV model.
However, learned counsel appearing for the
respondent-authorities contends that as per the
judgment of the Supreme Court and the extant
Regulations, new vehicles, for the purpose of grant of
permanent permit, have to comply with BS-IV
standards.
The matter is adjourned till April 07, 2022 when
learned counsel for the respondents is requested to
produce copies of the said judgment of the Supreme
Court and the concerned Regulation.
