1. The complaint has been filed against the petitioner alleging non-payment of amount in spite of receipt of goods. Towards part payment of the said amount, the petitioner had issued cheque which was dishonoured. During pendency of proceedings before the learned Magistrate, the petitioner made part payment of the amount. The issue is covered by the judgment in the case of S.W. Palnitkar Vs. State of Bihar, (2002) 1 SCC 241.

2. Arguable questions are raised. Rule.

3. There shall be interim relief in terms of prayer clause (iii).
