1 The First Appeal is filed being aggrieved by dismissal of Suit No.2513/2009 on 9/3/2022.

While the Suit was dismissed, the City Civil Court, Dindoshi, passed the following order :-

"Plaintiff intend to file Appeal against judgment and decree. The ad-interim order was in existence in favour of the plaintiff. Hence the effect and operation of the judgment and decree is stayed for a period of one year"

The said order was subsequently extended by further period of two weeks.

2 In the wake of the aforesaid order, issue notice to the respondents in the First Appeal.

The learned counsel waive notice on behalf of the Corporation i.e. respondent no.1.

3 Notice to the respondents is made returnable on 4/7/2022.

4 In the mean time, the order passed by the learned trial Court shall continue to remain in operation.
