On 18.9.2025, the following order was passed:-
"1. Supplementary affidavits filed on behalf of the applicant and the opposite party no. 2 are taken on record.
2. Heard learned counsel for the parties and perused the record.
3. Instant application under section 482 Cr.P.C./528 of the B.N.S.S.,2023 has been filed with the prayer to quash the charge-sheet no.49/2015 filed in Case Crime No.308/2015, under Sections 376, 323, 504 and 506 IPC read with Sections 3(2)V SC/ST Act lodged at Police Station Mall, District Lucknow, to quash the entire proceedings of Case No.62/2016 (State Vs. Ravikant Yadav @ Mannu), pending in the court of learned Special Judge, SC/ST Act, District Lucknow and to quash the order dated 25.01.2016 passed in the aforesaid case.
4. It is argued by learned counsel for the applicant that the alleged victim in annoyance lodged the FIR for committing rape upon her though no such rape has ever been committed by the applicant. He added that good sense prevailed and the parties have settled their dispute amicably by way of executing a compromise deed dated 16.06.2025. He submits that the alleged victim has performed marriage and has established her marital life with her husband and the applicant has also performed marriage and is living with his own family. He further submits that if the alleged victim/informant would be called in witness-box, she will again face trauma.
5. In support of his contentions, he has placed reliance upon the judgement of the Hon'ble Supreme Court in the case of Madhukar and Others versus State of Maharashtra and Another in SLP (Crl.) No.7212 of 2025 wherein it has has held that if the alleged victim has settled her life by performing marriage since long back and is not interested to pursue the case, allowing further criminal proceeding would prolong the distress for all concern especially the complainant and the victim and the exercise of the trial would likelihood of no productive outcome.
6. Paragraph 7 of the aforesaid judgment is referred as follows:-
"7. In the present matter, we are confronted with an unusual situation where the FIR invoking serious charges, including Section 376 IPC, was filed immediately following an earlier FIR lodged by the opposing side. This sequence of events lends a certain context to the allegations and suggests that the second FIR may have been a reactionary step. More Importantly, the complainant in the second FIR has unequivocally expressed her desire not to pursue the case. She has submitted that she is now married, settled in her personal life, and continuing with the criminal proceedings would only disturb her peace and stability. Her stand is neither tentative nor ambiguous, she has consistently maintained, including through an affidavit on record, that she does not support the prosecution and wants the matter to end. The parties have also amicably resolved their differences and arrived at a mutual understanding. In these circumstances, the continuation of the trial would not serve any meaningful purpose. It would only prolong distress for all concerned, especially the complainant, and burden the Courts without the likelihood of a productive outcome"
7. On the other hand, learned counsel for the opposite party no. 2 has supported the contentions of learned counsel for the applicant.
8. Learned AGA for the State has no objection.
9. In view of the foregoing reasons and submissions, the applicant and the opposite party no. 2 are directed to remain present before this Court on 25th Sep.,2025 at 2.15 p.m.
10. Respective counsels shall inform their clients about this order.
11. List/put up this matter on 25.09.2025 at 2.15 p.m.
12. Till the next date of listing, the further proceedings, arising out of Case Crime No.308/2015, under Sections 376, 323, 504 and 506 IPC read with Sections 3(2)V SC/ST Act lodged at Police Station Mall, District Lucknow, shall remain stayed."
In compliance of the order aforesaid, the opposite party no. 2/victim, Roop Rani and the applicant, Ravikant Yadav @ Mannu are present before this Court.
On query being asked, she submitted that she performed marriage in year 2015 and under certain misconceptions, she had lodged the first information report for committing rape, but such offence has never been committed upon her. She submitted that after some time, both have decided to live separately and both have performed marriage separately.
Both the counsels for the parities have jointly prayed that the criminal proceeding against the applicant may be dropped.
Learned A.G.A. appearing for the State has no objection to the submissions aforesaid.
Considering the submissions of counsel for the parties, it is evident that both applicant and opposite party no.2 have performed marriages separately and they have settled their marital life. This Court has also noticed that if the victim would be called in witness box, she will again face trauma.
The case of the present applicant is covered with the ratio of judgment rendered in the case of Madhukar & ors. versus The State of Maharashtra & Anr. in SLP (Crl.) No.7212 of 2025.
Accordingly, entire criminal proceedings against the applicants in Case No.62/2016 arising out of in Case Crime No.308/2015, under Sections 376, 323, 504 and 506 IPC read with Sections 3(2)V SC/ST Act lodged at Police Station Mall, District Lucknow, are hereby quashed.
The personal appearance of opposite party no. 2, Roop Rani and the applicant, Ravikant Yadav @ Mannu is hereby exempted.
The compromise deed shall be part of this order.
The application is allowed accordingly.
