Heard learned counsel for the petitioner and Sri S.B.Pandey, learned Senior Advocate cum Deputy Solicitor General of India assisted by Sri Varun Pandey, learned counsel for the respondents.
At the very outset, Sri Sri S.B.Pandey points out that the father of the petitioner was a Central Government employee and consequently the claim of the petitioner for compassionate appointment would be cognizable before the learned Central Administrative Tribunal keeping in view the law laid down by a Constitution Bench judgment of Hon'ble the Supreme Court in the case of L. Chandra Kumar vs. Union of India and others reported in AIR 1997 SC 1125.
Accordingly, the writ petition is disposed of leaving it open to the petitioner to file a claim petition before the learned Central Administrative Tribunal.
