1. Heard Sri Akhilesh Chandra Dwivedi, learned counsel for the plaintiff-petitioner and Sri A.P. Paul for Defendant-Respondent Nos. 1 and 2.

2. In view of the order which is being proposed to be passed today, notices are not being issued to plaintiff-respondent.

3. The limited relief sought in the present petition is for a direction to the Court of Civil Judge (Sr. Div.)-6, Kanpur Nagar to consider. decide and conclude the Execution Case No.4 of 1992 purported to be under Order 22 Rule 1 CPC for execution of the judgment / order and decree dated 21.01.1992 passed in Case No. 61 of 1992 (Smt. Shashi Yadav and another Vs. Kanpur Development Authority and another).

4. The learned counsel for the Kanpur Development Authority, defendant-respondent nos. 1 and 2 submits that in case the execution application is pending, then the same needs to be decided subject to any legal impediment in that regard.

5.Considering the facts of the case in totality, the present petition stands disposed of requiring the Court of Civil Judge (Sr. Div.)-6, Kanpur Nagar to decide the Execution Case No.4 of 1992 purported to be under Order 22 Rule 1 CPC for execution of the judgment / order and decree dated 21.01.1992 passed in Case No. 61 of 1992 (Smt. Shashi Yadav and another Vs. Kanpur Development Authority and another) with most expedition without granting unnecessary delay, of course subject to legal impediment, if any and cooperation of the parties.
