HIGH COURT OF JUDICATURE AT ALLAHABAD ?Neutral Citation No. - 2023:AHC:176683 Court No. - 10 Case :- WRIT - C No. - 30493 of 2023 Petitioner :- Vishal Panwar And 4 Others Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Akhilesh Kumar Counsel for Respondent :- C.S.C. Hon'ble Kshitij Shailendra,J.
1. Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents.
2. Learned counsel for the petitioners states that the case is covered by decision of this Court dated 6.7.2023 passed in a bunch of writ petitions connected with Writ-C No.9773 of 2023 (Sakshi and 77 others vs. State of UP and 32 others).
3. Learned Standing Counsel, by referring to paragraphs 23 and 26 of the said judgment, submits that this Court has already clarified that those, who have not pressed their claims arising out of concerned circulars/office memoranda, would not be entitled for the same benefits.
4. I do not find anything on record to demonstrate that the petitioners ever agitated their claim before the Writ Court or even before the authorities and without any foundation they just want to take advantage of the decision of the Writ Court although Paragraphs 23 and 26 of the judgment are clear to the effect that the judgment shall not be treated as binding precedent in all cases. The petitioners have utterly failed to claim parity with the petitioners of Writ-C No.9773 of 2023 (Sakshi and 77 others vs. State of UP and 32 others) and connected matters.
5. Accordingly, the writ petition is dismissed.
