This criminal revision has been preferred against the judgment and order dated 29.1.2008 passed by learned Additional District & Sessions Judge (F.T.C.-4) District Gonda in Sessions Trial No. 35 of 2006, arising out of Case Crime No. 112 of 1988, under Sections 336 and 323 IPC Police Statio Dhaneypur, District Gonda whereby the accused respondent nos. 2 and 3 have been acquitted of the charges levelled against them.
Perusal of record shows that in this case several dates were fixed i.e.14.10.2022, 14.12.2022, 13.3.2023 to argue the case but the learned counsel for revisionist this way or that way failed to argue the case.
Perusal of report of learned Chief Judicial Magistrate, Gonda dated 10.01.2023 shows that opposite party no. 2 Jai Jai Ram is reported to be no more and respondent no. 3 Kamal Kumar is living in Ludhiana.
Keeping in view the fact that learned counsel for revisionist failed to appear to argue the case and by efflux of time, this criminal revision has become infructous and the same is hereby dismissed as having become infructuous.
Interim order, if any, stands vacated.
