Heard learned counsel for the applicant and learned A.G.A. for the State.

The instant anticipatory bail application has been filed on behalf of the applicant, Mahendra Singh Rana,with a prayer to release him on bail in Case Crime No. 09 of 2023 under Sections 420,467,468,471,506 I.P.C., Police Station Kutubsher, District Saharanpur during pendency of trial.

By the order dated 1.03.2023, the interim anticipatory bail was granted to the applicant granting time to learned A.G.A. to file counter affidavit.

Despite time granted, no counter affidavit has been filed.

For the reasons given in earlier interim order dated 1.3.2023, this anticipatory bail application is allowed.

The applicant is already on interim anticipatory bail. He shall continue in anticipatory bail on same terms and conditions as given in earlier order dated 1.3.2023 as per judgement of the Apex Court in the case ofSushila Aggarwal vs. State (NCT of Delhi)- 2020 SCC Online SC 98,till the submission of police report, if any, under section 173 (2) Cr.P.C. before the competent Court.

In case, the applicant misuses the liberty of anticipatory bail, the Court concerned may take appropriate action in accordance with law and judgment of Apex Court in the case ofSushila Aggarwal vs. State (NCT of Delhi)- 2020 SCC Online SC 98.
