Heard Sri Utkarsh Srivastava, learned counsel for the petitioner and Sri Anubhav Chandra, learned standing counsel for the State-respondents.

By the impugned order dated 31.08.2022, the character certificate granted to the petitioner was suspended by the District Magistrate, Jhansi. The petitioner has filed the present writ petition to quash the aforesaid order dated 31.08.2022 and the report dated 24.08.2022. Against the impugned order, the petitioner has a remedy of appeal before the Division Commissioner in view of the Government Order dated 02.02.2023 and our judgment dated 20.02.2023 in Writ-C No.28220 of 2022 (Rajendra Prasad vs. State of U.P. and others).

In view of the aforesaid, the writ petition is dismissed leaving it open for the petitioner to file an appeal before the Divisional Commissioner. In the event, such an appeal is filed by the petitioner within four weeks from today along with a certified copy of this order, it shall be decided by the Divisional Commissioner in accordance with law by a speaking and reasoned order, after affording reasonable opportunity of hearing to the petitioner, expeditiously, preferably within six weeks from the date of filing of the appeal.

Certified copy of the impugned order and report filed as Annexures 1 and 2 to the writ petition, shall be returned by the office to the counsel for the petitioner within two weeks after retaining a photostat copy thereof in the records..
