Sri B.B. Upadhyay, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Qasim against the judgment and order dated 24.01.1995 passed by IInd Addtional Sessions Judge, Muzaffarnagar in Special Case No. 14/9 of 1993, under Sections 376/34 IPC read with Section 3(2)(v) SC/ST Act, Police Station Chhapar, District Muzaffarnagar.

As per office report dated 08.02.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 27.09.2021 informed that the appellant - Qasim has died on 09.11.2017. In support of which a report of concerned police station and the copy of death certificate issued by Government of Uttar Pradesh and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
