The present appeal has been filed by the appellant Ram Phal against the judgment and order dated 20.03.1995 passed by Additional Sessions Judge, Hamirpur in Sessions Trial No. 314 of 1991, under Section 333/34 IPC, Police Station Biwar, District Hamirpur.  As per office report dated 03.02.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 21.07.2020 informed that the appellant - Ram Phal has died in the year 1998. In support of which a report of concerned police station and the copy of death certificate issued by village pradhan and the copy of the statements of the other witnesses have also been annexed thereto.  Accordingly, the appeal stands abated.  Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.  Order Date :- 2.3.2023 M.
