Matter taken up in the revised list. No one appears on behalf of the appellants to press this appeal. Sri B.B. Upadhyay, learned counsel for the State is present.

The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellants against the judgment and order dated 6.8.1985 passed in S.T. No. 377 of 1984.

As per the office report dated 31.3.2023, a report of C.J.M., Banda dated 9.5.2022 has been received stating therein that the appellant no.1 Dharam Singh has died 10 years back and appellant no.2 Chandrapal Singh has died 12 years back. The said report has been sent after due inquiry.

This Court has perused the said report which states that both the accused-appellants have died around 10 years and 12 years back respectively.

In view of the above, the appeal stands abated.

File consigned to records.

Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
