Matter taken up in the revised list. No one appears on behalf of the appellants to press this appeal. Sri B.B. Upadhyay, learned counsel for the State is present.

The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellants against the judgment and order dated 20.12.1984 passed in S.T. No.116 of 1983.

As per the office report dated 1.2.2023, a report of C.J.M., Ballia dated 17.5.2022 and 23.12.2021 have been received stating therein that the appellant no.1 Mukti Nath and appellant no.2 Baikunth Nath alias Goga have died in the year 2005 and around 15 year back respectively. The said report has been sent after due inquiry.

This Court has perused the said report which states that both the accused-appellants Mukti Nath and Baikunth Nath alias Goga have died in the year 2005 and around 15 years back respectively.

In view of the above, the appeal stands abated.

File consigned to records.

Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
