"It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to allow this petition and set aside the impugned order dated 28.4.2023, passed by District Judge, Maharajganj in Misc. Civil Appeal No. 41 of 2022 (Ali Hasan Versus Sitaram and others) and judgment and order dated 29.11.2021 passed by Civil Judge ( Junior Division), Maharajganj in Original Suit No. 817 of 2020 (Ali Hasan Versus Sitaram and others) (Annexure No.1 and 2 to this petition)."

2. Despite the matter being taken up in the revised call, no one appears to press this petition.

3. Sri Pramod Kumar Pandey, learned counsel for the respondent is present.

4. This petition is dismissed for non prosecution.
