1. Matter taken up in the revised list. No one appears on behalf of the appellant to press this appeal. Sri Ajay Singh, learned counsel for the State is present.

2. The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 1.5.1986 passed by VII Addl. Sessions Judge, Moradabad in S.T. No.166 of 1984 and 307 of 1985.

3. As per the office report dated 4.4.2023, a report of C.J.M., Amroha dated 12.11.2021 has been received stating therein that the sole appellant Jai Prakash has died on 5.1.2015. The said report has been sent after due inquiry.

4. This Court has perused the said report which states that the accused-appellant has died.

5. In view of the above, the appeal stands abated.

6. File consigned to records.

7. Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
