3. Sri Ajay Singh, learned State counsel is present, who has been heard.

4. The present appeal has been filed by the appellants- Lalmani and Bhagwan Das against the judgment and order dated 25.02.2005 and 03.02.2007 passed by Sessions Judge, Sonbhadra in Case No. 12 of 2005, Police Station Pannuganj, District Sonbhadra.

5. As per office report dated 23.11.2021 a report from C.J.M. concerned was called for regarding living status of the appellants in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 29.09.2021 informed that the appellants- Lalmani and Bhagwan have died on 20.06.2018 and in the year 2008 respectively. In support of which a report of concerned police station and the copy of death certificate issued by village pradhan and the copy of the statements of the other witnesses have also been annexed thereto.

6. Accordingly, the appeal stands abated.

7. Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
