1. This First Appeal From Order has been filed under section 173 of Motor Vehicle Act, 1988 (hereinafter referred to 'Act, 1988') by appellant being aggrieved by judgment and award dated 2.11.1995 passed by the Motor Accident Claims Tribunal/XIIth Additional District Judge, Agra in Claim Case No.106 of 1990 awarding sum of Rs.80,000/- with interest at the rate of 12%.

2. Both the parties have decided to amicably settle the dispute on the condition that the appellant would be entitled to additional sum of Rs.3,00,000/- over and above amount granted as this is an appeal of the year 1996.

3. The amount be deposited within six weeks from today failing which the insurance company would pay 6% interest on the enhanced amount.

4. In view of the above, this appeal is disposed off.

5. This Court is thankful to the learned counsel for the parties to amicably settle this very old matter .
