2. Heard Sri Jitendra Pal Singh, learned counsel for the appellant and Sri Virendra Pratap Singh, learned counsel for the State.

3. The present appeal under Section 374 Cr.P.C has been preferred by the appellant against the judgment and order dated 16.2.2006 passed by Special Judge/S.C./S.T. Act, Pilibhit in S.T. No.769 of 1996 (State Vs. Sumer Lal and another).

4. As per the office report dated 5.7.2023, a report of C.J.M., Pilibhit dated 9.5.2023 has been received stating therein that the sole appellant Ram Pal has died on 11.06.2013. The said report has been sent after due inquiry.

5. This Court has perused the said report which states that the accused-appellant Ram Pal has died on 11.06.2013.

6. In view of the above, the appeal stands abated.

7. File consigned to records.

8. Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
