Heard learned counsel for the petitioner as well as learned A.G.A.

The present petition is being targeted against the judgment and order dated 28.10.2022 passed by learned Additional District and Sessions Judge, Court no.10, Muzaffar Nagar in Criminal Revision No.239 of 2019 under sections 156(3) Cr.P.C. Police Station-Budhana, District-Muzaffar Nagar and order dated 12.07.2019 passed by learned Chief Judicial Magistrate, Muzaffar Nagar.

I have perused the material available on record and there is a settled principal of law against the petitioner in the case of Sakiri Vasu v. State of U.P., reported in (2008) 2 SCC 409 and the petitioner has got a remedy to file a complaint. If so advised, the petitioner may file complaint case which shall be decided by the court concerned within next four months from the date of its filing on merits.

With the aforesaid observations, the present petition stands disposed of.
