Hearing of the present appeal has been expedited by the Apex Court way back in the year 2020. In our previous order, it was indicated that the matter shall be heard finally.

Arguments have been commenced on behalf of the accused-appellants by their counsels, namely, Mr. Noor Mohammad and Mr. A.C. Srivastava, Advocates but after some arguments, we are compelled to adjourn the matter as we have been informed that a cross case was also lodged from the side of accused-appellants being Case Crime No. 160-A of 2005 in which three accused are stated to have been sentenced to 3 years imprisonment. However, details of sessions trial or the judgment passed therein have not been placed before us.

It is urged on behalf of the accused-appellants that if the hearing is adjourned by two weeks, they would make all endeavour to trace out the details of the cross case and apprise its present status.

List this appeal along with connected appeals on 19th January, 2023 amongst top ten cases in order to enable the learned counsel for the accused-appellants, Mr. P.K. Singh, learned counsel appearing for the informant/complainant as also the learned A.G.A. for the State to place before the Court the details of the alleged cross case.
