Heard learned counsel for the appellant and learned A.G.A. for the State.

This is an appeal filed under Section 374 (2) Cr.P.C. against the judgment and order dated 10.05.1990 passed in S.T. No.453 of 1988, under Section 302 I.P.C. convicting the appellant and sentencing him to imprisonment for life.

A report was sought from the C.J.M., Lakhimpur Kheri vide order dated 19.11.2019 with regard to the living status of the appellant, i.e., Santosh Singh. If the appellant is no more, a complete verified death report was to be obtained.

Office report dated 25.11.2022 reveals that a compliance report from the C.J.M., Bahraich dated 05.12.2022 has been received and as per the said report and the report, the sole appellant i.e. Santosh Singh has died which has been duly verified by the police station concerned. The death certificate of the appellant issued by Gram Pradhan and the statements of Amandeep Singh, Jugal Kishore Gram Pradhan and S.I. Prameet Kumar with respect to the death of the sole appellant are on record.

As per the report of report of C.J.M., Lakhimpur Kheri, the I/c Registrar (J)(L) has also put up a report, according to which, the sole appellant died.

In view of the aforesaid facts and circumstances of the case, the present appeal stands abated as the sole appellant is no more.

File is consigned to record.
