Heard learned counsel for the appellant and learned A.G.A. for the State.

This is an appeal filed under Section 374 (2) Cr.P.C. against the judgment and order dated 21.03.1995 passed in S.T. No.230 of 1993, under Section 302 /34 I.P.C. convicting the appellant and sentencing him to imprisonment for life.

A report was sought from the C.J.M., Unnao with regard to the living status of the appellant, i.e., Sri Pal Yadav.

Office report dated 05.01.2023 reveals that a compliance report from the C.J.M., Unnao dated 24.12.2022 has been received and as per the said report, the sole appellant i.e. Sri Pal Yadav has died which has been duly verified by the police station concerned. The death certificate of the appellant issued by Gram Pradhan and the statements of S.I. Vijay Kumar, P.S. Maurawa, District Unnao and Prema (daughter of the deceased) with respect to the death of the sole appellant are on record.

As per the report of report of C.J.M., Unnao, the Registrar (J)(E) has also put up a report, according to which, the sole appellant died.

In view of the aforesaid facts and circumstances of the case, the present appeal stands abated as the sole appellant is no more.

File is consigned to record.
