Sri Jogendra Nath Verma, learned counsel for the respondent no.2 has filed counter affidavit, which is taken on record.

Heard Sri Rama Niwas Pathak, learned counsel for the petitioner, learned Standing Counsel appearing for respondent no.1 and Sri Jogendra Nath Verma, learned counsel for respondent no.2.

Learned counsel for the petitioner has submitted that the case of the petitioner is squarely covered by the judgment of this Court passed at Allahabad in Writ-C No.37399 of 2022 in re:Bal Govind Patel Smarak Degree College And 3 Other vs. State of U.P. and others, decided on 20.12.2022.

Sri Jogendra Nath Verma, learned counsel for respondent no.2 has opposed the prayer but he did not dispute the fact that the case of the petitioner is squarely covered with the aforesaid judgment.

Accordingly taking into consideration the aforesaid consensus, the present petition is disposed of in light of the aforesaid judgment passed in the case of Bal Govind Patel Smarak Degree College (supra).

It is provided that the petitioner would also be entitled for the benefit of the judgment of Bal Govind Patel Smarak Degree College (supra).
