HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH

?Court No. - 1

Case :- SPECIAL APPEAL No. - 20 of 2022

Appellant :- Prem Chandra Verma(Pc Verma)

Respondent :- State Of U.P. Thru. Prin. Secy. Medical Health U.P. Civil Secretariat And 2 Others

Counsel for Appellant :- Arun Saxena

Counsel for Respondent :- C.S.C.

Hon'ble Ramesh Sinha,J.

Hon'ble Subhash Vidyarthi,J.

Heard Shri Arun Saxena, learned counsel for the appellant and Shri Indrajeet Shukla, learned Additional Chief Standing Counsel for State-respondents and perused the material brought on record.

The instant Special Appeal has been filed by the appellant with a prayer (i) to quash the impugned judgment and order dated 22.12.2021 passed by learned Single Judge in Writ Petition No. 7508 (S/S) of 2014; Prem Chandra Verma vs. State of U.P. and others (ii) as well as quash the impugned order of suspension dated 15.04.2011 passed by opposite party no.3 and accordingly allow the special appeal.

At the outset Shri Indrajeet Shukla, learned Additional Chief Standing Counsel for State-respondents has drawn the attention of this Court towards the prayers made in the present special appeal and pointed out that so far as prayer no.(ii) is concerned, the same does not survive as the learned Single Judge has already passed an order dated 22.12.2021 in Writ Petition No. 7508 (S/S) of 2014 and the petitioner has also retired from his services, hence, no cause of action appears to survive for quashing of the suspension order dated 15.04.2011.

In view of the aforesaid submissions made, the instant special appeal is hereby, dismissed with liberty to the petitioner to approach appropriate forum for redressal of his grievance, if so aggrieved.

(Subhash Vidyarthi, J.) (Ramesh Sinha, J.)
