1. Heard learned counsel for the petitioner; Shri Anand Kumar Chaubey, learned counsel for Union of India and learned counsel holding brief of Shri Pranjal Mehrotra, learned counsel for the IDBI Bank.
2. Present writ petition has been preferred for a direction to respondent authorities to pay the remaining amount of Deep Discount Bond of Rs.1,80,943/- along with highest interest on late payment.
3. At the very outset, learned counsel for the respondent-Bank has raised an objection regarding the maintainability of the writ petition on the ground that a writ petition is not maintainable against private bank. In support of his submissions, he has placed reliance on the judgment in Federal Bank Ltd. v. Sagar Thomas & Ors., (2003) 10 SCC 733.
4. We have proceeded to examine the record in question and find substance in the objection raised by learned counsel for the respondent-bank. As such, we are not inclined to interfere in the matter.
5. The writ petition stands dismissed accordingly.
