Heard learned counsel for the petitioner, learned Standing Counsel for the respondent and perused the record.

This writ petition has been filed by the petitioner challenging an order dated 29.09.2023, which was preferred against an order dated 12.07.2021 passed against the petitioner, whereby recovery was directed against the petitioner as well as the petitioner was placed under the black-list for the period of two years.

Earlier the petitioner had approached this Court by filing a writ petition i.e. Writ C No. 30937 of 2021, which was disposed of directing the revisional authority to decide the matter afresh in the light of the judgment of this Court in the case of Vipul Tyagi Vs. State of U.P. & Others (Writ C No. 17258 of 2020, dated 11.02.2021), however, despite specific directions, prima facie, there appears to be no consideration of the said judgment.

Considering that on the prima facie reading of the impugned revisional order dated 29.09.2023, the earlier directions given by this Court in Writ C No. 30937 of 2021 have not been considered. To avoid any further delay, this Court deems it appropriate to set aside the order dated 29.07.2023 with direction to hear and pass fresh orders strictly as per the directions given by this Court in the judgment dated 24.04.2023 passed in Writ C No. 30937 of 2021.

Needless to say that till the decision of the revision, no coercive steps shall be taken against the petitioner.

With the aforesaid directions, this writ petition stands disposed of.
