Heard Shri Jitendra Vikram, learned counsel for the petitioner, Shri Upendra Singh, learned Additional Chief Standing Counsel and Shri Dilip Kumar Pandey, learned counsel for the respondents nos.6 & 8/ Gaon Sabha

Learned Additional Chief Standing Counsel raised a preliminary objection that this petition for a direction for withdrawing the consolidation proceeding and issue notification under Section 6(1) of Consolidation of Holdings Act to cancel the notification under Section 4(1) of the Consolidation of Holdings Act is not maintainable in view of judgment passed by Division Bench of this Court in the case of M/S Runup Grammodyog Evam Sewa Sansthan Vs. State of U.P.; 2022 (155) RD 497 being legislative function, learned counsel for the petitioner, after going through the same, could not dispute the same.

In view of above, this petition is dismissed.
