Prayer in the present petition is for a mandamus directing the second respondent, Kendriya Vidyalaya Sangathan, New Delhi to manage interview of the petitioner after fixing a short date for the post of Primary Teacher in vacancy No. 16 of 2022 under direct recruitment quota.
Sri Krishna Ji Shukla, learned counsel and Sri D.P. Singh, learned counsel for the respondents have raised preliminary objection regarding maintainability of the writ petition on the ground that the writ petitioner has an alternative remedy while filing an original application before the Central Administrative Tribunal in view of the judgment of the Hon'ble Supreme Court in the case of L. Chandra Kumar Vs. Union of India AIR 1997 Supreme Court 1125.
Learned counsel for the writ petitioner could not dispute the said legal proposition and accordingly, the present writ petition is consigned to record, leaving it open for the writ petitioner to approach the Central Administrative Tribunal having jurisdiction over the matter.
