Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material on record.

Instant Criminal Misc. Application under Section 483 Cr.P.C. has been filed by the applicant who is complainant in Criminal Misc. Case No. 2271 of 2022 filed under Section 128 Cr.P.C., with prayer to issue necessary directions to Principal Judge Family Court, Jaunpur to decide the case expeditiously and within a stipulated period as fixed by this Court.

Learned counsel for the applicant submitted that application under Section 128 Cr.P.C. has been filed by the applicant, with a view to execute the judgment and order dated 01.10.2022 passed by Addl. Chief Judge Family Court 1, Jaunpur in Maintenance Case no. 1754 of 2020 under Section 125 Cr.P.C. Opposite party has appeared in the case and moved an application to stay realization warrant issued against him in the case and directing payment of arrears of maintenance in easy and equal installments.

From perusal of record, it appears that the Court below is proceedings in the case in effective manner and no delay occurred due to proceedings in the case, however, an application under Section 128 Cr.P.C. has been filed by the applicant for execution of the judgment under Section 125 Cr.P.C.

The court concerned is directed to expedite the hearing of the case and make every efforts to decide the case as expeditiously as possible without granting any unnecessary or long adjournments to either of the parties, preferably within a period of 6 months from the date of production of a certified copy of this order, provided there is no legal impediment.

Accordingly, the application stands disposed of.
