Heard Shri Chetan Kumar Tiwari, Advocate holding brief of Shri Dev Mani Mishra, learned counsel for the petitioner, Shri Gaurav Vishwakarma, Advocate holding brief of Shri R.K. Chaudhary, learned counsel for the respondent No.2 and Shri S.K. Khare, learned Standing Counsel.

This Court had passed the following order on 29.04.2020:-

"Shri Chetan Kumar Tiwari, Advocate holding brief of Shri Dev Mani Mishra, learned counsel for the petitioner submits that the petitioner, on account of ensuing elections of the local bodies, is being pressurized to deposit her firearm whereas the same cannot be directed to be deposited in view of the guidelines issued by this Court by means of judgment and order dated 29.03.2007 passed in Tula Ram Yadav vs. State of U.P. and others in Writ Petition No.1487 (M/S) of 2007. Learned counsel for the petitioner also submits that the petitioner is residing in rural area whereas the election is to be held in urban area, therefore also the firearm cannot be directed to be deposited.

Learned Standing Counsel prays for and is granted three days' time to seek instructions.

List on 25.04.2023 in top ten cases."

learned Standing Counsel on the basis of instructions submits that the petitioner has never been pressurized for depositing her arm license on account of ensuing Urban Local Body Elections and the arm license shall not be got deposited except in accordance with law and the guidelines issued by this Court. The petition has been filed merely on apprehension.

In view of the above, the writ petition is disposed of in terms of the statement of learned Standing Counsel.
